Terms of Service

Welcome to PitchWise. By downloading, installing, or using our mobile application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the app.

1. Description of Service

PitchWise is a mobile application that provides baseball bullpen tracking, pitch analytics, team management, and practice planning tools for coaches and athletes.

2. Account Registration

To use PitchWise, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate information and promptly update it if it changes.

3. User Roles

Athletes may create a free account, join teams, log personal bullpen sessions, and view their statistics. Coaches may create teams, manage rosters, log sessions for athletes, create practice plans, and access team analytics. Coach features beyond the free tier require a paid subscription.

4. Subscriptions and Payments

Coach subscriptions are billed through Apple's App Store. By purchasing a subscription, you agree to the following:

Payment is charged to your Apple ID account at confirmation of purchase
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
Your account will be charged for renewal within 24 hours prior to the end of the current period
You can manage and cancel subscriptions in your App Store account settings
Free trial periods, if offered, are forfeited when you purchase a subscription

Current subscription tiers and pricing are displayed in the app and are subject to change with reasonable notice.

5. Acceptable Use

You agree not to:

Use PitchWise for any unlawful purpose
Attempt to gain unauthorized access to other users' accounts or data
Interfere with or disrupt the service or servers
Upload malicious content or spam
Impersonate another person or entity
Use the app to harass, bully, or harm others
Scrape, data-mine, or reverse engineer the application

6. Content and Data

You retain ownership of the pitching data and content you create in PitchWise. By using the service, you grant us a license to store, process, and display your data as necessary to provide the service. Coaches who manage teams can view the pitching data of athletes who have joined their team.

7. Privacy

Your use of PitchWise is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Disclaimer of Warranties

PitchWise is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, secure, or error-free. PitchWise is not a substitute for professional coaching, medical advice, or athletic training guidance.

9. Limitation of Liability

To the maximum extent permitted by law, PitchWise and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to loss of data, athletic injury, or interruption of service.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time through the app settings.

11. Changes to Terms

We may modify these Terms at any time. Continued use of PitchWise after changes constitutes acceptance of the updated Terms. We will make reasonable efforts to notify users of significant changes.

12. Governing Law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict of law principles.
